Recently I have notived that some of my photographs as well as some of those from other contributors to both this site and TriniTuner have been appearing in other magazines.
While it is flattering, to some extent, that publishers deem it necessary to download photos from the websites to use in their publications, I am not aware of any agreement that allows usage of these photos.

below are some copyright guidelines regarding photography

1. Who owns the copyright on photographs?
The photographer automatically owns the copyright to every photograph that he/she takes.
(Staff photographers are the exception to this rule since the copyright will belong to the company that hires them.)

2. What is copyright ownership?
A copyright owner has the exclusive right to decide whether or not his/her photograph(s) should or should not be reproduced, distributed or licensed.

3. What is Photographic Credit?
A photographer has the right to choose whether or not his/her identity will be associated with the photograph(s) taken.
The Copyright Act refers to this as a moral right which can be waived as part of a usage agreement or contract.

4. What is a Release?
A release is a legally binding contract in which permission is granted to include an individuals likeness or property in a photograph for commercial use such as advertising.
Primarily, there are two types of releases that relate to photography: Property Release and Model Release.
